Ordos has introduced a standardized procedure for foreign-invested enterprises to update their registration details, providing guidance on the approvals and administrative steps required for different types of changes.
When a foreign-invested enterprise initiates an amendment application, they must first determine whether the change requires prior approval. If prior approval is needed, the enterprise must complete the necessary approval procedures before submitting the amendment to the market supervision department. For changes not requiring prior approval, enterprises can directly submit their applications for review.
During the review process, the market supervision department checks if the amendment involves the Foreign Investment Negative List. If it does, further verification is conducted to ensure compliance with the list's requirements. If the amendment complies, or if it does not involve the negative list, the change will be registered.
After the business registration changes, additional procedures are required based on the amendment type: changes in basic information, investment details, mergers, splits, relocations, or currency require foreign exchange registration updates; changes in business address, financial officers, accounting methods, or tax filers necessitate tax information updates; a change in the enterprise name requires a new company seal; and changes to account opening documents require bank account updates. Once all related procedures are completed, the amendment process is finalized.
This standardized process makes it easier for foreign-invested enterprises to update their registration details, improving the quality of administrative services in the foreign investment sector.
